By creating an account, accessing, or using Serene Space AI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

• You must be at least 18 years old to use this Service
• If you are between 13-17 years old, you may only use the Service with explicit parental or guardian consent

• Cultural Competency: Culturally-informed care across diverse backgrounds

3.2 What Serene Space AI Does NOT Provide

• ❌ Medical diagnosis or treatment recommendations
• ❌ Prescription medications or medication management
• ❌ Emergency crisis intervention (call 988 or 911)
• ❌ Legal advice or court documentation
• ❌ Licensed human coach sessions
• ❌ Guarantees of specific mental health outcomes

3.3 AI Limitations

You acknowledge and understand that:

• AI technology is not perfect and may make mistakes or provide incomplete responses
• AI cannot fully replicate the nuance and empathy of a human coach
• AI cannot assess non-verbal cues or body language
• AI cannot provide emergency intervention or real-time crisis support

4. User Account

4.1 Account Creation

To use the Service, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for:

• Keeping your login credentials confidential
• Using a strong, unique password
• Not sharing your account with others
• Logging out from shared or public devices

4.3 Account Termination

You may terminate your account at any time by:

• Using the account deletion feature in your settings

We reserve the right to suspend or terminate accounts that violate these Terms.

• Monthly: $29.99/month (unlimited sessions)
• Annual: $299.99/year (unlimited sessions, save $60)

5.2 Billing Terms

• Automatic Renewal: Subscriptions renew automatically unless canceled
• Payment Processing: All payments processed securely through Square
• Billing Date: You will be charged on the same day each billing cycle
• Failed Payments: Service may be suspended for failed payments

5.3 Cancellation Policy

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months
• You will retain access to the Service until the end of your paid period

5.4 Refund Policy

Fair Refund Policy: We want you to be satisfied with Serene Space AI. Our refund policy is based on usage and timing to ensure fairness to both you and our service.

FREE 7-Day Trial:

• No charge during the 7-day trial period
• Cancel anytime during trial with no charge
• No credit card required to start trial

$29.99/Month Plan:

• Full refund within 7 days if fewer than 3 coaching sessions completed
• 50% refund within 7 days if 3-10 coaching sessions completed
• No refund if 10 or more coaching sessions completed
• No refund after 7 days from purchase

$299.99/Year Plan:

• Full refund within 30 days if fewer than 5 coaching sessions completed
• Pro-rated refund within 30 days if 5-20 coaching sessions completed
• No refund if 20 or more coaching sessions completed
• No refund after 30 days from purchase

Technical Issues:

If you experience technical problems that prevent you from accessing the Service, contact info@serenespace.ai within 24 hours of the issue for immediate assistance and potential refund eligibility.

How to Request a Refund:

Email info@serenespace.ai with your order number and reason for the refund request. Refunds are processed within 5-7 business days and returned to your original payment method.

Important Note:

Serene Space AI provides mental health coaching, not clinical therapy. Refunds are based on usage and timing, not subjective assessments of "results," as personal growth and mental health improvement take time and consistent effort.

Cancellation: You may cancel your subscription at any time through your account settings. You will retain access to the Service until the end of your current paid period. Refunds for early cancellation are subject to the policy above based on usage and timing.

6. User Conduct and Prohibited Uses

6.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

6.2 Prohibited Conduct

You may NOT:

• ❌ Use the Service for illegal activities
• ❌ Attempt to hack, reverse engineer, or compromise the Service

You may NOT:

You retain ownership of all content you create or share through the Service (coaching conversations, journal entries, etc.).

By using the Service, you grant us a license to:

• Analyze de-identified, aggregate data for research purposes

We will NEVER share your identifiable content without your explicit permission.

8. Disclaimers and Limitations of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free service
• Warranties of specific mental health outcomes

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Serene Space AI is NOT liable for any indirect, incidental, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Service in the past 12 months
• We are NOT responsible for outcomes of using (or not using) the Service

8.4 No Guarantee of Results

We do NOT guarantee that the Service will:

• Cure or treat any mental health condition
• Prevent negative mental health outcomes
• Meet all your individual needs
• Be suitable for your specific situation

9. Indemnification

You agree to indemnify and hold harmless Serene Space AI, its founders, employees, and partners from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your negligence or misconduct

10. Crisis Situations and Emergency Protocols

10.1 AI Cannot Provide Crisis Intervention

Our AI is designed for supportive conversations, NOT crisis intervention. If the AI detects crisis language, it will:

• Provide crisis hotline numbers (988, 741741, 911)
• Encourage you to seek immediate professional help
• Remind you that AI cannot handle emergencies

10.2 Mandatory Reporting

In certain situations, we may be legally required to breach confidentiality:

• Imminent threat to yourself or others
• Child abuse or neglect
• Elder abuse or neglect
• Court orders or legal proceedings

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We use medical-grade security standards (AES-256 encryption + TLS 1.3) and comply with state health data privacy laws
• All data is encrypted in transit and at rest
• We NEVER sell your data to third parties
• You have rights to access, correct, and delete your data

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

13. Termination

14.2 Arbitration Agreement

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except:

• Small claims court disputes ($10,000 or less)
• Intellectual property disputes

14.3 Class Action Waiver

You agree to bring disputes on an individual basis only and waive the right to participate in class action lawsuits.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
